MEMPHIS, TN (abc24.com) - A fatal crash involving a Tennessee state official and former Shelby County Election Commissioner remains under investigation. An 8-year old Memphis child was killed just days before Christmas, when Bill Giannini was involved in a three-car accident.

He didn't want to do an on camera interview, but said he is devastated by what has happened.

Bill Giannini is currently the Assistant Commissioner of the Tennessee Department of Commerce and Insurance.

The accident occurred on December 22. According to the police report, he was driving west on I-40 just past the Fayette County line. Traffic was stopped for an accident on the interstate when Giannini came over a hill and crashed into two cars; one vehicle flipped over.

Not only was an 8-year-old child killed, four others were injured. A spokesperson for the Tennessee Highway Patrol says the department is waiting a toxicology report before deciding if charges will be filed against Giannini. That is expected to take six to eight weeks.

Giannini was not injured. In the meantime, he says is so upset he is taking some time off work. No word on when he'll return to his job in Nashville.
