12-Year-Old Arrested For Not Wearing Helmet at Memphis Skatepark

MEMPHIS, TN (abc24.com) - A Memphis boy is shaking his head and preparing for a court date, after he was arrested for skateboarding without a helmet.

For 12-year-old William Faulhaber, the trouble all started two weeks ago when his dad dropped him off at the new skate park in Midtown. William says he quickly realized he had forgotten his helmet.

He says he never heard a Memphis police officer warn everyone to either put on their helmets or leave the park.

"I didn't hear that," Faulhaber tells abc24.com. "I didn't see that coming.  If I had seen it coming, I would have called my dad and told him to bring my helmet."

Faulhaber says the next thing he knew, the officer was telling him to put his hands behind his back and putting handcuffs on him.

According to cell phone video taken at the scene, the officer can be heard saying, "I will be arresting every time I come by. I will be arresting somebody, whoever is not wearing a helmet."

Faulhaber says the officer drove him to his dad's house.

Hans Faulhaber, William's father, says he doesn't understand the fuss at the skatepark, when he's been robbed at gunpoint twice and his home has been burglarized.

"I think those are more pressing issues then arresting a 12-year-old for not wearing a helmet," says Faulhaber. "But that's just my opinion."

Currently, Memphis doesn't have a law requiring helmets at the park.  An MPD spokesperson declined to comment on the officer's actions, but did tell abc24.com Faulhaber was arrested for criminal trespassing.  He was issued a summons to appear in juvenile court.

On Tuesday, December 6, 2011, the Memphis City Council will consider an ordinance that would allow officers to ticket those without a helmet. That ticket would come with a $50 fine.

I stopped reading comments after the first 12 or so. But, what I gathered was that everyone, including the District Attorney and the Editor of this newspaper, is overlooking the one thing that matters: If it is not against the law, if no such law is in existence at the timne of this incident, then the officer unlawfully arrested someone. You know aht that amounts to? Kidnapping! Mr. District Attorney, when will you drop the charges and then bring charges against the officer? You have his "arrest report", so a trial would be a moot point. The officer's justification is irrelevant; he broke the law.

This is completely ridiculous. It's "skate at your own risk" for a reason. Where I live, there is no law or ordinance saying you have to wear a helmet in our city skatepark, and you shouldn't have to! To the cops in Memphis - THIS IS WHY WE CAN'T HAVE NICE THINGS.

Golden Taint: lol That's a funny name... I digress. You're onto something when you say, "If you have a problem with government's rules, then don't play on their property..." I'm not sure if you meant to write, "their property," but that is a very astute observation.

Wow, you people really overreact to such simple issues. The officer was surely trying to make a statement about the on-going helmet issue. I'm sure the child wasn't hurt in any way. You'd think that the cop had beat and maced the boy, the way you hippies carry on. The stupid skate park has rules, obey them and have fun. If you have a problem with the government's rules, then don't play on their property and build your own damn skate park.

OMG Leave the kids alone. It's a control issue with Police. I would have sued the cops for false arrest.There was no ordinance at the time. Some of you say, he may have saved the kids life. A cop-out for Police corruption. Our rights are quickly being taken from us, people, can't you see this? We have the right to wear or not wear a helmet. The city needs to put up a sign that states, use park at your own risk! Then there would be no Police interference and the city would not be held liable! Don't be harassed by the Police State! Take back your Country! This kid will now have a police record! And believe me it will count against him some day! Keep our kids out of the system...

Typical Memphis! The kid should have worn a helmet and the cop would have been right to admonish him - however - cuffing is an unnecessary power trip by the cop. Easier (and safer) to bully a child than to go after criminal - oh, I forgot Memphis crime is down so the MPD only needs to go after children and jaywalkers. When was the last time you picked up the CA and did not find several stories about burglaries, robberies, rapes, murders, and carjackings? But crime is down except for those pesky children without helmets and the troublesome jacywalkers and litterbugs.

Those of you defending this cop make me sick. If this cop actually cared about the cop he would have said "Do you have a helmet? Well then lets go get yours" Instead he is power tripping sociopath who thinks he should be in charge of everyone. If some stranger came by the skate park and tied your kids hands behind their back and drove off with them becuase they were not wearing a helmet you would probably be ok with that because he did it for the children. Oh wait that's exactly what happened, a stranger came and tied up a boy and kidnapped him for not wearing a helmet. This guy should lose his job and do jail time for kidnapping and unlawful arrest. FACT.

Helmets have always been required at skateparks. This goes back to the 70's when the first parks were built.

This cop may have saved this kid's life. A 12 year old generally speaking isn't ready to skate a park without AT LEAST a helmet. This kid's parents should have taken initiative, brought the kid's helmet with him, and supervised his skating. The summons is for criminal trespass not a helmet violation. They were warned beforehand...don't follow the rules and you are no longer authorized to use the park for skating, and you are trespassing. This kid either didn't listen, hear the warning everyone else heard or care.
