Hearing Set in Deadly Henning Post Office Shooting

MEMPHIS, Tenn. (AP) - A federal judge is scheduled to hear motions concerning the mental health evaluation of a former corrections officer charged with fatally shooting two post office workers during a robbery.

Chastain Montgomery is expected to appear before Jon Phipps McCalla, chief judge for the Western District of Tennessee, on Wednesday afternoon.

Montgomery has pleaded not guilty to charges that he and his 18-year-old son killed Paula Robinson and Judy Spray after robbing the Henning post office of just $63 in October 2010.

Montgomery's lawyers have said that they intend to use a mental health evaluation to show that Montgomery is mentally retarded.

Defense attorneys say they are willing to provide a summary of the evaluation but have balked at the government's request for more specific information regarding the mental health report.
