MEMPHIS, TN (abc24.com) - A hung jury led the judge to declare a mistrial for a former Memphis police officer accused of pulling a gun during an incident of road rage.
Amy Dunn was charged with aggravated assault in the incident. She was fired from the department last August.
Prosecutors representing Phyllis Davis alleged that Dunn, then a Memphis police officer, pointed a gun at her after the two got into an argument as they were driving in the area of Sycamore View and Macon in June 2011.
Dunn maintained her innocence, sending the case to trail on November 13. A mistrial was declared November 16 after the jury was unable to reach a unanimous decision.
The District Attorney's office will decide whether to retry Dunn by next week. Dunn's attorney, Leslie Ballin, did not immediately say whether she would try to get her job back with the Memphis Police Department, where she served for more than ten years prior to her termination.
