@ Morgan - No. In some cases, if youre found to be driving over the speed limit by 25 mph and involved in accident, it will typically be considered the fault of the driver who was speeding. This exact same thing happened to a guy in my fraternity house. He was traveling 30 mph over the limit, hit a car turning left. He was found at fault, and actually charged with attempted manslaughter due to the injuries of the person he hit, which was later dropped. He was still found at fault for the accident.

It is very unfortunate that people died, I am sure the officer takes no joy in knowing this could have be avoided! Not to sure of the witness statement, if the driver was making a left hand turn in front of oncoming traffic, would that not make it his fault?
