MEMPHIS, TN (abc24.com) - A burglary suspect was shot after the homeowner caught him in the act on November 30, 2011.

Shelby County Sheriff's deputies responded to a shooting call on the 7400-block of Locke Road in Millington around 9:15pm. When they arrived, the homeowner told them he had come home to find his front door open with his belongings stacked outside. He went inside and said he was "charged" by the suspect. The homeowner then pulled out a gun and shot the suspect.

The suspect attempted to flee the scene, but was held at gunpoint until deputies arrived. He was transported to The Med in extremely critical condition, and later identified as 38-year-old Jeffrey Butcher.

The homeowner did have a permit to carry a gun. The incident is still under investigation.

It says the homeowner DID have a permit. However doesn't matter in this case as he was in the house.

The homeowner did not have a weapons permit. Sorry he was in his own home, should have gotten him outside. All legal here. Now give him his medal for his brave act.
