MEMPHIS, Tenn. (AP, abc24.com) - A man accused of shooting to death an off-duty Memphis police officer is getting a new capital murder trial after a state appeals court threw out his previous conviction.
Timothy McKinney was convicted and sentenced to death in 1999 for the shooting of 37-year-old Don Williams, who was working off-duty as a security guard at a comedy club when he was shot in the back of the neck.
The Commercial Appeal reports that McKinney's new capital murder trial will start Monday with jury selection. The Tennessee Court of Criminal Appeals awarded him a new trial in 2010 after ruling that his attorneys failed to investigate the case, prepare for trial or present evidence favorable to McKinney.
