JACKSON, MS (abc24.com) - He's accused of misspending taxpayer money, and after hours of testimony the court is no closer to a decision in Southaven Mayor Greg Davis' civil trial. The case is continued to May, so it will be months before it's resolved.
At issue is whether Davis owes the remaining $77,000 the state auditor's office has demanded, or if he will get back the $96,000 he's already paid.
In two days the judge has heard from three witnesses, the mayor's ex-wife and two Southaven Aldermen.
The entire morning and most of the afternoon was dedicated to Alderman Ronnie Hale's testimony. The court is reviewing receipts and bills Davis submitted to the city and what controls were in place over his spending.
They're going line by line, and it's taking time.
From wine purchases in Napa to trips all over the U.S. and to Canada, the state had Hale review charge after charge Mayor Greg Davis billed to the City of Southaven.
Hale told the court aldermen approved the mayor's spending on trust; the money Davis used was part of Southaven's travel and tourism fund.
The board authorizing the spending has been a major sticking point for the defense, which grilled Hale for approving Davis' expenses then later questioning them.
Hale testified that aldermen weren't told how much money Davis spent until the day of the board meetings and never given any receipts. Still, the mayor's charges were approved.
Attorney: You approved every single one of them didn't you?
Hale: Based on information given to me, yes. Not strictly just from documentation.
Attorney: At that point you had questions. You didn't think he was telling truth but you approved them because you believed them to be business expenses, didn't you.
Hale: We were assured through his office and the city attorney and what little documentation we had they were legitimate expenses, yes.
State investigators, the mayor's secretary, Southaven's city clerk and Davis' partner are still expected to testify. They will all take the stand in May when the trial reconvenes.
